U.S. SEC Proposes New Rules for the Crypto Industry: Safe Harbor and Relief for Token Issuances

The U.S. Securities and Exchange Commission (SEC) has proposed new rules aimed at creating a safe haven for cryptocurrency startups and simplifying the token issuance process. The proposed changes provide temporary regulatory relief for early-stage blockchain projects, allowing them to develop innovative products without the immediate risk of violating existing securities laws.

As part of the initiative, the SEC plans to introduce a three-year “safe harbor” period during which startups will be able to issue and distribute their tokens without having to immediately register them as securities. During this time, companies will be required to ensure transparency, provide open access to source code, disclose information about their team and business model, and implement user protection mechanisms.

According to the SEC, such measures could stimulate innovation in a sector that has already attracted more than $40 billion in investment over the past year alone. The new rules also provide exemptions for certain types of tokens, which will help accelerate the legal launch of new platforms and services. The regulator emphasizes that after the grace period expires, projects will be required to comply with all standard requirements for public companies.

Experts note that the proposed changes could make the U.S. a more attractive jurisdiction for cryptocurrency companies and reduce risks for investors thanks to increased transparency and a clear regulatory framework.
